Aplicabilidade dos benefícios previdenciários para transexuais

Abstract

Resumo: O presente estudo teve como objetivo analisar a aposentadoria para transexual. O instituto em análise vem sendo discutido já há algum tempo no Brasil, porém somente esse ano de 2019, que foi concedido o primeiro benefício para transexual, sem a obtenção de uma legislação específica para sedimentar esse direito e minimizar os impactos que esta polêmica causa na sociedade e no Judiciário. A aposentadoria é um benefício que o trabalhador aposentado recebe mensamente. A aposentadoria para o transexual é um assunto contemporâneo na sociedade brasileira. Os indivíduos transexuais encontram diariamente inúmeras dificuldades para viver e sobreviver na sociedade, ainda há muita discriminação, que é denominada transfobia para esse grupo. Os transexuais não conseguem atingir a idade mínima para se aposentar, seja homem ou mulher, pois são vítimas de uma sociedade preconceituosa. Por esse motivo temos o caso de somente uma brasileira que obteve êxito na aposentadoria. Recentemente, em Agosto de 2019, houve a aposentadoria de forma integral da primeira brasileira transexual. Um grande avanço para o direito previdenciário e para o movimento LGBT+, que cada dia mais conquistam uma nova vitória.

Abstract: The present study aimed to analyze retirement for transsexuals. The institute under review has been discussed for some time in Brazil, but this year 2019, which was granted the first benefit for transsexuals, without the use of specific legislation to ettle this right and reduces the damage that this controversi al cause occurs in society and in the judiciary. Retirement is a benefit that the retired worker receives monthly. Retirement for transsexualsis a contemporary issue in Brazilian society. Transgender individuals are subject to many difficulties to live and survive in society, there is still much discrimination, which is called transphobia for this group. Transsexuals do not reach the minimum age to retire, whether male or female, because they are victimsof a prejudiced society. For this reason, we have the case of only one Brazilian who succeeded in retirement. Recently, in August 2019, there was a full retirement of the first Brazilian transsexual. A major break through for social security law and the LGBT + movement, which has increasingly won a new victory.
