Culpa consciente e dolo eventual nos homicídios causados por embriaguez no trânsito

Abstract

Resumo: O presente trabalho de graduação busca analisar os delitos cometidos no trânsito, em específico o crime de homicídio causado por motorista embriagado, concomitantemente com a evolução dos regulamentos que buscaram coibir essa prática reprovável em nosso ordenamento jurídico e sua eficácia no plano prático. O estudo, inicialmente, buscou delinear e diferenciar os institutos do dolo eventual e culpa consciente. Também trouxe um breve escorço histórico sobre o trânsito brasileiro, seus regulamentos iniciais, até culminar no Código de Trânsito Brasileiro vigente. Em seguida, os delitos cometidos no trânsito foram abordados de forma sucinta, por meio do apontamento do texto legal e a análise doutrinária do respectivo texto. Por fim, tratou-se da discussão da aplicação do dolo eventual e culpa consciente nos crimes de trânsito, em especial nos homicídios no trânsito causados por motorista embriagado ou sob a influência de qualquer outra substância psicoativa que determine dependência. São apontados os posicionamentos jurisprudenciais quanto ao tema, a alteração realizada no texto legal pela Lei nº 13.546/17 e a problemática de sua aplicação no plano prático. A elaboração do presente trabalho foi fundamentada em livros, artigos, pesquisas jurisprudenciais, trabalhos acadêmicos e dados obtidos em órgãos competentes.

Abstract: The present undergraduate work seeks to analyze traffic offenses, specifically the crime of homicide caused by a drunk driver, concurrently with the evolution of the regulations that sought to curb this objectionable practice in our legal system and its effectiveness in practical terms. The study initially sought to delineate and differentiate the institutes from eventual intent and conscious guilt. It also brought a brief historical foreshortening of the Brazilian traffic, its initial regulations, until culminating in the current Brazilian Traffic Code. Subsequently, traffic offenses were briefly addressed by pointing to the legal text and doctrinal analysis of the respective text. Finally, it was a discussion of the application of possible intent and conscious guilt in traffic crimes, especially traffic murders caused by a drunk driver or under the influence of any other psychoactive substance that determines dependence. The jurisprudential positions on the subject are pointed out, the alteration made in the legal text by Law No. 13.546 / 17 and the problematic of its application in the practical plan. The elaboration of this work was based on books, articles, jurisprudential research, academic works and data obtained from competent bodies.
