Liberdade sindical : no ordenamento jurídico brasileiro e na convenção n° 87 da OIT

Abstract

Resumo: O presente trabalho visa analisar os aspectos individuais e coletivos da liberdade sindical em âmbito internacional e no ordenamento jurídico brasileiro. Primeiramente, busca a entender o surgimento do movimento sindical em âmbito internacional e nacional, entendendo as fases em que o Estado reconhecia ou não as organizações sindicais. Por fim trata a respeito dos aspectos da liberdade sindical em âmbito internacionais introduzidas pela convenção n° 87 da OIT, bem como os aspectos da liberdade sindical no Ordenamento Jurídico brasileiro, seja eles introduzidos nos texto constitucionais e infraconstitucionais, trazendo os avanços e as retrações trazidas pela Constituição da Republica de 1998. Para tais anseios utiliza-se da revisão de cunho bibliográfico para o embasamento de todo estudo aqui desenvolvido, encontrando como o principal resultado a harmonização das leis brasileiras, para assim o Brasil ratificar a convenção n° 87 da OIT, para finalmente obter em nosso Ordenamento Jurídico Pátrio, a Liberdade sindical Plena, sugerida pela Organização Internacional do Trabalho.

Abstract: This paper aims to analyze the individual and collective aspects of freedom of association at international level and in the Brazilian legal system. Firstly, it seeks to understand the emergence of the trade union movement at the international and national levels, understanding the phases in which the State recognized or not the trade union organizations. Finally, it deals with the aspects of freedom of association in international scope introduced by ILO Convention No. 87, as well as the aspects of freedom of association in the Brazilian Legal System, whether they are introduced inthe constitutional and infraconstitutional texts, bringing the advances and retractions brought by the Constitution of the Republic of 1998. For such desires we use the revision of bibliographic nature for the base of all study developed here, finding as the main result the harmonization of Brazilian laws, so that Brazil ratifies ILO Convention No. 87 , finally to obtain in our Patio Juridical Order the Full Trade Union Freedom, suggested by the International Labor Organization.
