Paternidade e maternidade socioafetiva

Abstract

Resumo: O trabalho a ser apresentado implica no estudo da paternidade e maternidade socioafetiva no ordenamento jurídico e na vida de todos os que envolvem o meio. Demonstra o estudo no antigo código civil e no novo ordenamento, o modelo de família patriarcal de antigamente e o novo modelo de família que se forma pela afetividade sem vinculo sanguíneo e genético. O seguinte trabalho de graduação informa as obrigações jurídicas ao assumir a grande responsabilidade de reconhecer um filho como se seu fosse, ressaltando este reconhecimento como uma demonstração de vontade voluntaria. O trabalho disponível ressalta a não possibilidade de revogação de paternidade socioafetiva uma vez que, foi reconhecida por livre e espontânea vontade. O presente estudo retrata também os problemas em sociedade, causados também por uma paternidade e maternidade socioafetiva após a separação dos genitores. Tratando-se assim uma criação cheia de conflitos entre a família biológica e a socioafetiva gerando mais conflitos também no âmbito sucessório e psicológico da criança e de um futuro adulto.

Abstract: The work to be presented implies the study of paternity and socio-affective motherhood in the legal system and in the lives of all those involved in the environment. It demonstrates the study in the old civil code and in the new order, the patriarchal family model of old and the new family model that is formed by the affection without blood and genetic bond. The following undergraduate work informs legal obligations by taking on the great responsibility of recognizing a child as his own, stressing this recognition as a demonstration of willing will. The available work emphasizes the possibility of revocation of socio-affective paternity since it was recognized by free and spontaneous will. The present study also portrays the problems in society, also caused by a paternity and socio-affective motherhood after the separation of the parents. Thus it is a creation full of conflicts between the biological family and the socio-affective, generating more conflicts also in the succession and psychological scope of the child and an adult future.
