A paternidade socioafetiva como consolidação das relações de parentesco

Abstract

Resumo: A sociedade enfrenta atualmente grandes conflitos familiares, decorrentes das relações interpessoais. Isso interfere diretamente o mundo jurídico, sendo de grande importância a definição da paternidade socioafetiva para consolidar as relações de parentesco. O presente trabalho tem por objetivo abordar a discussão acerca do instituto da paternidade socioafetiva, bem como algumas consequências jurídicas no âmbito do direito de família, pontuando a importância de se garantir que aos filhos, não advindos de uma relação biológica, obtenham o mesmo amparo legal que os filhos consanguíneos. Trata-se de uma temática atual e extremamente relevante para o ordenamento jurídico, principalmente no que tange ao reconhecimento dos direitos dos filhos advindos de uma relação de afeto e as obrigações adquiridas pelo pai socioafetivo. A instituição familiar ganhou nova roupagem com a evolução da sociedade, assim, a consanguinidade ou registro civil não são mais elementos determinantes para que se fale em paternidade. Uma análise legislativa, doutrinária e jurisprudencial, fundadas em princípios, foi realizada acerca do reconhecimento da paternidade socioafetiva e seus desdobramentos jurídicos.

Abstract: Society currently faces major family conflicts arising from interpersonal relationships. This directly interferes with the legal world, and the definition of socio-affective paternity is very important to consolidate kinship relations. This paper aims to address the discussion about the institute of socio-affective paternity, as well as some legal consequences in the field of family law, highlighting the importance of ensuring that children, not coming from a biological relationship, obtain the same legal protection. that the inbred children. This is a current issue and extremely relevant to the legal system, especially regarding the recognition of the rights of children arising from a relationship of affection and the obligations acquired by the socio-affective father. The family institution has taken on a new guise with the evolution of society, so that consanguinity or civil registration are no longer determining elements for talking about paternity. A legislative, doctrinal and jurisprudential analysis, based on principles, was performed about the recognition of socio-affective paternity and its legal consequences.
