O direito dos animais na legislação brasileira

Abstract

Resumo: O presente trabalho tem como objetivo reunir e apresentar a legislação existente que vigora no país com intento de propiciar o amparo legal aos animais pertencentes à fauna brasileira. Busca-se apontar que as correntes antropocêntricas e especistas, embora muito influentes na sociedade do país, são ideais contrários, que caminham na contramão do rumo à evolução que os seres humanos necessitam. Caminho que muitos indivíduos, cujo véu do egoísmo ruiu, já o percorrem. Na tentativa de apresentar um olhar sob uma perspectiva diversa daquela do ser humano, centro do universo, propõe-se reflexões acerca do reconhecimento da importância dos seres que dividem o planeta conosco, e dos desnecessários atos praticados contra a vida dos animais em virtude da vaidade e imposição da dominância impiedosa de alguns indivíduos humanos. Com base na análise das leis mais importantes sobre o assunto, demonstra-se a mudança da mentalidade da sociedade acerca dos animais, e a conseqüente evolução ao longo do tempo da legislação disposta sobre eles. Aponta-se também a necessidade da imputação de penas mais rigorosas ante determinadas práticas criminosas, além de uma fiscalização exercida com maior eficiência, para que haja, de maneira veraz, uma proteção àqueles que não podem falar.

Abstract: This undergraduate thesis has the objective of gathering and presenting the existence of legislation that prevails in the country with intent to provide legal protection to the animals belonging to the Brazilian fauna. It is sought to point out that the anthropocentric and spectral currents, although very influential in the society of the country, are ideal opposites, that go against the direction of evolution that humans need. Way that many individuals, whose veil of selfishness has collapsed, already travel through it. In an attempt to present a view from a perspective different from that of the human being at the center of the universe, we propose reflections on the recognition of the importance of the beings that divide the planet with us and of the unnecessary acts practiced against the lives of animals by virtue of vanity and imposition of the merciless dominance of some human individuals. Based on the analysis of the most important laws on the subject, it shows the change of the mentality of the society about the animals, and the consequent evolution over time of the legislation disposed on them. It is also pointed out the need to impose stricter penalties on certain criminal practices, as well as a more effectively exercised oversight, so that there is a truthful protection for those who cannot speak.
