Filiação socioafetiva : Efeitos Jurídicos no Direito Sucessório

Abstract

Resumo: O significado de família vem sofrendo mudanças ao decorrer desses anos, mudanças essas sofridas no âmbito político, econômico e social. O conceito de família foi afetado, a família patriarcal e matrimonial retratada no Código Civil de 1916, foi aos poucos se distanciando da realidade. Após a promulgação da Constituição Federal de 1988, abriu mais espaços e expandiu o sentido de família. Hoje podemos ter em nosso ordenamento a filiação socioafetiva, que é aquela formada por afeto, está ligada entre o sentimento do indivíduo, e vai muito além de laços sanguíneos e biológicos. Este novo tipo de paternidade é objeto de análise do presente trabalho, que visa abordar os aspectos mais relevantes da filiação socioafetiva. Para isso será necessário explanar sobre os conceitos de família, analisando os aspectos do Código Civil de 1916 e de 2002, e da Constituição Federal, abordando o conceito de filiação, e suas formas de reconhecimento, como também quais serão esses efeitos na vida da criança ou do adolescente. E principalmente, quais são os efeitos jurídicos no direito sucessório. Além disso, será de suma importância a utilização de grandes doutrinadores brasileiros, bem como a análise de decisões judiciais que completam o entendimento dos Tribunais sobre esta nova espécie de paternidade.

Abstract: The meaning of family has undergone changes over these years, changes suffered in the political, economic and social spheres. The concept of family was affected, the patriarchal and matrimonial family portrayed in the Civil Code of 1916, was gradually distancing itself from reality. After the promulgation of the Federal Constitution of 1988, it opened more spaces and expanded the sense of family. Today we can have in our order the socio-affective filiation, which is that formed by affection, is linked between the individual's feelings, and goes far beyond blood and biological ties. This new type of paternity is the object of analysis in this work, which aims to address the most relevant aspects of socio-affective filiation. For this, it will be necessary to explain the concepts of family, analyzing aspects of the Civil Code of 1916 and 2002, and the Federal Constitution, addressing the concept of affiliation, and its forms of recognition, as well as what these effects will be on the child's life. or the teenager. And mainly, what are the legal effects in inheritance law. In addition, the use of great Brazilian scholars will be of paramount importance, as well as the analysis of court decisions that complete the Courts' understanding of this new kind of paternity.
