A responsabilidade civil do advogado no exercício da profissão

Abstract

Resumo: Esta monografia foi pensada e desenvolvida no sentido de relacionar temas da responsabilidade civil do advogado ao exercício da profissão de advogado com base na sua formação acadêmica até a sua inscrição na Ordem dos Advogados. De forma contenciosa e com base no material legislativo pertinente a profissão de advogado, o objetivo geral foi tornar explícito a todos a responsabilidade civil do advogado e de que forma é aplicada no meio atual. A relevância da questão da profissão de advogado e o seu exercício estão diretamente relacionados a dois eixos: Ética e Direito, tornando-os são indiscerníveis. O "dar a mão" que está na origem do contrato de mandato que implica vínculos intensíssimos de confiança e lealdade. O vínculo ético não se restringe, todavia, à relação advogado e cliente. A Advocacia é, por força da Constituição Federal, "indispensável à administração da justiça". O Advogado é um transmissor de cultura e um agente do bem comum: sua atividade não se aparta da ética da responsabilidade. A garantia constitucional dada à advocacia implica, em contrapartidas, deveres do advogado para com a sociedade e para com o país.

Abstract: This monograph was designed and developed in order to relate issues of civil liability of lawyers to the practice of lawyer, based on their academic training up to their enrollment in the Portuguese Bar Association. In a contentious way and based on the legislative material relevant to the profession of lawyer, the general objective was to make explicit to everyone the civil liability of the lawyer and how it is applied in the current environment. The relevance of the issue of the legal profession and its exercise are directly related to two axes: Ethics and Law, making them indiscernible. The "giving a hand" that is at the origin of the mandate contract, which implies extremely intense bonds of trust and loyalty. The ethical bond is not restricted, however, to the lawyer and client relationship. Advocacy is, by force of the Federal Constitution, "indispensable to the administration of justice". The Lawyer is a transmitter of culture and an agent of the common good: his activity does not depart from the ethics of responsibility. The constitutional guarantee given to the legal profession implies, in return, the lawyer's duties towards society and towards the country.
