Os transexuais e os estabelecimentos prisionais em razão de sua identidade de gênero

Abstract

Resumo: A presente monografia analisa em qual estabelecimento prisional, se feminino ou masculino, os transexuais são destinados ao cumprimento de suas penas impostas pela prática de atos atentatórios ao ordenamento jurídico penal. O trabalho tem o condão de demonstrar acerca da transformação histórica do tema na sociedade brasileira, com consequentes efeitos tanto no pensamento coletivo em si, bem como na influência que o ordenamento jurídico sofreu. Nele, aspectos sociais, legais e jurisprudenciais são abordados com vistas ao esclarecimento de como atualmente a alocação das pessoas transexuais submetidas ao sistema prisional do país se dá. O trabalho, através de revisão bibliográfica com coleta de dados sob análise exploratória em fontes disponíveis em meios físicos e em sítios na rede mundial de computadores, apresenta que homens e mulheres transexuais poderão cumprir a pena em unidade prisional condizente com sua identidade de gênero autodeclarada. A monografia ainda conclui que a preferência jurisprudencial vai no sentido de que os homens e mulheres transexuais cumpram a pena em unidade prisional feminina, dadas as condições mais salutares e seguras.

Abstract: This monograph examines which prison, female or male, transsexuals are destined to serve their sentences – imposed for the practice of acts that violate the criminal legal system. The work is able to demonstrate the historical transformation of the theme in Brazilian society, with consequent effects both on collective thinking itself, as well as on in the influence that the legal system suffered. In it, social, legal and jurisprudential aspects are addressed to clarify how currently the allocation of transgender people subjected to the country's prison system takes place. The monograph, by bibliographic review with data collection under exploratory analysis study on sources available in physical media and on sites on the global web of computers, shows that transsexual men and women will be able to fulfill the prison sentence consistent with their self-declared gender identity. The work also concludes that the jurisprudential preference goes in the direction of that transgender men and women should serve their sentences in female prisons, that provide the healthiest and safest conditions.
