Alienação parental : consequências jurídicas da implantação de falsas memórias

Abstract

Resumo: O presente trabalho de graduação tem como objetivo analisar as consequências jurídicas da implantação das falsas memórias na Alienação Parental, a fim de proporcionar uma maior conscientização à sociedade como um todo, principalmente aos operadores de direito e a toda equipe multidisciplinar e, para tanto, foi utilizado o método dialético, desenvolvido através de pesquisas bibliográficas, utilizando-se doutrinas, jurisprudências, artigos científicos, revistas jurídicas dentre outros. Sabe-se que a Alienação Parental pode se dar de inúmeras formas e terá como enfoque a implantação das falsas memórias, que consiste na manipulação do menor, a fim de distorcer um fato real para que a criança passe a cocriar uma nova realidade, realidade esta que o progenitor alienante deseja que o menor se recorde. O genitor alienante, que geralmente carrega algum ressentimento do ex-companheiro, utiliza deste método friamente para se vingar do outro progenitor, sem se importar com o melhor interesse da criança e sem respeitar o princípio da dignidade da pessoa humana prevista no art.226 da Constituição Federal. Importante destacar a evolução do conceito de família tida pelo Código Civil de 1916 e o Código Civil de 2002, o qual foi desbancado o modelo de família patriarcal, trazendo direitos mais abrangentes as mulheres e rompendo com o pátrio poder. Com toda essa evolução se fez necessário analisar a Alienação Parental com maior cuidado e maior abrangência, e diante desta necessidade, foi criada a Lei 12.318/10, que trata dessa temática e todos os seus desdobramentos. As consequências são inúmeras, tanto para o menor quanto ao outro progenitor, principalmente quando se trata de uma falsa acusação de abuso sexual, tendo em vista que pode romper totalmente o laço familiar com a perda do poder familiar e até mesmo uma condenação penal injusta. Por outro lado, deve ser feita uma análise minuciosa, pois o genitor não pode ser valer dessa justificativa de alienação parental para elidir uma acusação verdadeira de abuso sexual. Conclui-se, que é importante que o Judiciário tenha uma equipe multidisciplinar, preparada para avaliar com precisão o caso, para não levar a erro o julgamento correto e acabar rompendo as relações familiares tão importantes para o desenvolvimento da criança.

Abstract: This graduation work aims to analyze the legal consequences of implantation false memories in Parental Alienation, in order to provide greater awareness to society as a whole, especially to law operators and the entire multidisciplinary team and, for this, it was used a dialectical method, developed through bibliographics researches, using doctrines, jurisprudence, scientific articles, legal journals, among others. It is known that a Parental Alienation can happen in different ways, and will focus on the implantation of false memories, which consists in the manipulation of the child, in order to distort a real fact so that a child starts to co-create a new reality, this reality that the alienating wants the child to remember. The alienating, who usually carries some resentments from the ex-partner, uses this method coldly to take revenge on the other parent, regardless of the child's best interest and without respecting the principle of human dignity provided in Article 226 of the Constitution Federal. It is important to emphasize the evolution of the concept of family taken by the Civil Code of 1916 and the Civil Code of 2002, which overturned the patriarchal family model, bringing more comprehensive rights to women and breaking with the patriarchal power. With all this evolution, it was necessary to analyze the Parental Alienation with greater care andd greatercoverage, and in view of this need was created the Law 12.318/10, which deals with this theme and all its consequences. The consequences are several, both for the minor and the other parent, especially when it comes to a false accusation of sexual abuse, since it can completely break the family bond with the loss of family power, and even an unjust criminal conviction. And, on the other hand, a thorough analysis must be made, since the parent cannot rely on this justification of parental alienation for a true accusation of sexual abuse. Therefore, it is concluded that it is important that the Judiciary has a multidisciplinary team prepared to accurately assess the case, so as not to lead to a mistake in the correct judgment and finish breaking up as family relationships so important for the child's development.
