Abstract

Resumo: A presente pesquisa visa explorar o crime lastimavelmente pouco divulgado do tráfico de pessoas. Para contextualizar o desenvolvimento desta conduta criminosa no seio social, primeiramente será apresentado um breve histórico sobre seu possível início, com o tráfico negreiro para fins escravagistas. Após este primeiro momento, caberá um aprofundamento nos diplomas legais internacionais que buscam coibir o ilícito, e sua influência nas leis nacionais. Ademais, o trabalho buscará apresentar as finalidades para as quais tal crime se destina, e em capítulo próprio será feita uma análise do tráfico de pessoas sob a ótica da violência de gênero, o tráfico com fins de exploração sexual. Por fim, caberá uma reflexão sobre a Lei Nacional 13.344/2016 que dispõe sobre a prevenção e repressão ao tráfico interno e internacional de pessoas e sobre medidas de atenção às vítimas. Após esmiuçar os aspectos fortes e possíveis lacunas desta recente lei, será apresentada a conclusão embasada em todo o previamente exposto.

Abstract: This research aims to explore the woefully little publicized crime of human trafficking. In order to contextualize the development of this criminal behavior in the social sphere, first a brief history of its possible beginning will be presented, with the slave trade for slave purposes. After this first moment, it will be necessary to deepen the international legal diplomas that seek to curb the illicit, and its influence on national laws. Furthermore, the work will seek to present the purposes for which this crime is intended, and in a separate chapter an analysis of human trafficking will be made from the perspective of gender violence, trafficking for the purpose of sexual exploitation. Finally, there will be a reflection on National Law 13344/2016, which provides for the prevention and repression of internal and international trafficking in persons and on measures to care for victims. After detailing the strong aspects and possible gaps of this recent law, the conclusion based on all of the previously exposed will be presented.
