Casamento e suas nuances

Abstract

Resumo: Essa presente pesquisa surgiu a partir do interesse em analisar algumas temáticas convergentes e divergentes sobre o casamento, tanto nas ciências jurídicas, quanto nas ciências psicológicas. Essa pesquisa teve como objetivo oferecer um diálogo entre a psicologia e as ciências jurídicas sobre o tema casamento. Através do estudo de alguns fundamentos, nestas duas áreas científicas, foi traçado um panorama sobre a contribuição de uma ciência com a outra. Metodologia, os dados foram obtidos através de livros e artigos científicos, logo, foi realizada uma revisão bibliográfica. Resultado, a pergunta chave que procurei esclarecer foi: Como podemos analisar a influencia social do casamento na legislação vigente? E vice-versa. O Código Civil de 2002, vigente hoje em 2021, carrega outra configuração legislativa, comparado ao Código Civil de 1916, por exemplo. O presente ordenamento jurídico, segundo alguns doutrinadores, é pautado na proposta do amor. Ou seja, a principal finalidade é que os casamentos, hoje, tenham como propósito um elo matrimonial formado com Amor, e não somente pela reunião dos bens. Desta forma, para solucionar os litígios entre os casais, nasceu o Direito Sistêmico, que muito tem colaborado com a harmonia dos ex casamentos, em termos jurídicos. Concluímos, que o ordenamento jurídico é dinâmico, por ser uma extensão dos fenômenos sociais da época. Sendo assim, ambas as ciências conversam intimamente sobre uma pluralidade de assuntos, que se tornam emergentes no decorrer do progresso histórico. Logo, o Direito Sistêmico através das constelações familiares, tem obtido resultados magníficos, para que as famílias em litígio aprendam a ordenar melhor suas demandas, e assim, obter um melhor resultado, ou um resultado eficaz o suficiente, para que esta questões não voltem novamente às ordens jurídicas. Por isso, podem optar por resolver as questões emocionais, ali mesmo, ou, procurar algum psicólogo especialista no assunto, para ajudar nestas exigências particulares.

Abstract: The following research begans by the point to analysing some convergences and divergences subjects of marriage, among the Legal Science and the Psychology. This research aims to offer a dialogue between bouth Science - Psychology and Legal Science - upon marriage. Through the knowledge of some elements in Psychoogical and Legal theory, it was traced the contribution of one Science to the other. Methodology, the particulars details were obtained through books and science articles. Thus, a bibliographic review was carried out. Result: the key question we tried to awnswered were: How could we analyze the social influence of marriage in the current legislation? And vice versa. The Civil Code of 2002, in force today in 2021, carries another legislative configuration, compared to the Civil Code of 1916, for exemple. The present legal system, according to some jurist indoctrinators, proposes the love in a relationships. So the main propose of the marriage is love, and not only the assets of the couple. In order to solve the marriage litigation, born the Systemic Law (Systemic Constellation in the Court Room). This issue has contributed greatly with the development of family systems, in legal terms. Conclusion, the legal system is dynamic, as it is a extension of the contemporary social phenomena. Therefore, bouth Science has a intimate conversation about a plenty of matters, and this become present in the historical progress. The Systemic Law, through the Family Constalation, has achieved a magnific result. The intention is to better order their family damand and promote a efficient result, with the goal of this litigation do not go back to the judiciary. And besides, they have the opportunity to settle their emotional demanda right there, at the same time or/and to search a psychologist, for help.
