Teletrabalho : uma análise do "novo normal" pós pandemia da COVID 19

Abstract

Resumo: O presente trabalho tem como objetivo uma análise sobre a modalidade do teletrabalho no Brasil. Para a realização do trabalho foi utilizado método descritivo- analítico que instruiu uma análise clara sobre o tema proposto e a metodologia utilizada foi com base em legislação e doutrina. Para tanto, foi feita uma análise da história do teletrabalho, sua evolução ao longo dos anos, e a recente legislação que foi regulamentada pela Lei 13.467/2017, observando as lacunas existentes, bem como os pontos positivos e negativos do instituto, que teve um exponencial crescimento no último ano. Isso porque, com o início da pandemia desencadeada pela COVID 19 e a necessidade de se manter um isolamento social como medida imprescindível para controlar a propagação do vírus, o teletrabalho se tornou o meio mais viável e eficaz de o trabalhador continuar laborando sem colocar sua saúde, de sua família e colegas de trabalho em risco. Embora o estado de calamidade pública tenha forçado muitos trabalhadores, que sequer conheciam a modalidade, a implementá-la em sua rotina, no Brasil o teletrabalho foi bem aceito pelos empregados e empregadoras, que agora vêem uma oportunidade de continuar laborando dessa forma mesmo após o término da pandemia.

Abstract: The present task aims to analyze the teleworking modality in Brazil. To carry out the task, a descriptive-analytical method was used, which instructed a clear analysis of the proposed theme and the methodology used was based on legislation and doctrine. To this end, an analysis was made of the history of telework, its evolution over the years, and the recent legislation that was regulated by Law 13.467/2017, observing the existing gaps, as well as the positive and negative points of the institute, which had a exponential growth in the last year. This is due to, with the onset of the pandemic triggered by COVID 19 and the need to maintain social isolation as an essential measure to control the spread of the virus, telework has become the most viable and effective way for workers to continue working without putting their health, his family and co-workers at-risk. Although the state of public calamity has forced many workers, who did not even know the modality, to implement it in their routine, in Brazil telework was well accepted by employees and employers, who now see an opportunity to continue working in this way even after the end of the pandemic.
