A quarta revolução industrial e o Direito : a advocacia 4.0

Abstract

Resumo: Da pré-história aos dias atuais a humanidade percorreu uma longa trajetória no caminho da evolução. Em sua história a humanidade passou por transformações que de tão abrangentes e abruptas foram denominadas de revoluções. A primeira dessas grandes revoluções foi a revolução do neolítico ou transição demográfica neolítica, também denominada de revolução da agricultura. Durante esse período o homem abandonou seu modo de vida nômade, de caçador-coletor, e se sedentarizou, adotando um modo de vida baseado na agricultura e criação de animais. Com o sedentarismo surgiram os primeiros assentamentos que deram origem às aldeias, às vilas e posteriormente às cidades e ao processo civilizatório. As cidades representam a grande revolução da humanidade. Sem elas não haveria civilização. Uma longa trajetória se seguiu, onde civilizações, impérios surgiram e se desvaneceram ao longo do tempo. Com a invenção da máquina a vapor, na segunda metade do século XVIII, teve início a Revolução Industrial. A Revolução Industrial é, provavelmente, o mais importante acontecimento na história desde a revolução agrícola e do surgimento das cidades. A Revolução Industrial provocou inúmeras transformações econômicas, políticas e sociais, consolidando o modo de produção capitalista. Com o capitalismo os homens foram alçados à condição abstrata de portadores de direitos. E, agora, estamos no limiar de uma nova revolução. A Quarta Revolução Industrial, também denominada de Revolução 4.0, é diferente de tudo que já foi experimentado antes pela humanidade. A Quarta Revolução Industrial alterará profundamente a maneira como vivemos, trabalhamos e nos relacionamos. A Quarta Revolução Industrial é impulsionada por tecnologias emergentes e inovações disruptivas que evoluem exponencialmente. A Quarta Revolução Industrial trará grandes desafios e, também, grandes oportunidades. Há profundas preocupações com a extinção maciça de postos de trabalho e o aprofundamento das desigualdades conduzindo ao aumento da violência e das tensões sociais. Nesse cenário novos horizontes à Ciência do Direito emergirão, de forma que nenhuma área do Direito passará incólume. O perfil do prestador de serviços jurídicos terá de ser reinventado. Uma nova modalidade de profissional jurídico deverá surgir: o Advogado 4.0.

Abstract: From prehistory to the present day humanity has come a long way on the path of evolution. In its history, humanity has undergone transformations that were so comprehensive and abrupt they were called revolutions. The first of these great revolutions was the Neolithic revolution or Neolithic demographic transition, also called the agricultural revolution. During this period man abandoned his nomadic way of life, hunter-gatherer, and settled down, adopting a way of life based on agriculture and animal husbandry. With sedentary lifestyle, the first settlements arose that gave rise to villages, towns and later to cities and the civilizing process. Cities represent the great revolution of humanity. Without them, there would be no civilization. A long trajectory followed, where civilizations, empires emerged and faded over time. With the invention of the steam engine, in the second half of the 18th century, the Industrial Revolution began. The Industrial Revolution is probably the most important event in history since the agricultural revolution and the rise of cities. The Industrial Revolution brought about countless economic, political and social transformations, consolidating the capitalist mode of production. With capitalism, men were raised to the abstract condition of having rights. And now, we are on the threshold of a new revolution. The Fourth Industrial Revolution, also known as Revolution 4.0, is unlike anything that has ever been experienced by mankind. The Fourth Industrial Revolution will profoundly change the way we live, work and relate. The Fourth Industrial Revolution is driven by emerging technologies and disruptive innovations that evolve exponentially. The Fourth Industrial Revolution will bring great challenges as well as great opportunities. There are deep concerns about the massive extinction of jobs and the deepening of inequalities leading to an increase in violence and social tensions. In this scenario, new horizons for the Science of Law will emerge, so that no area of Law will pass unscathed. The profile of the legal service provider will have to be reinvented. A new type of legal professional should emerge: Lawyer 4.0.
