Melhor interesse da criança : um estudo sobre a guarda compartilhada

Abstract

Resumo: O presente trabalho de graduação consiste numa revisão bibliográfica, cujas fontes de pesquisa consultadas foram a legislação atual e pretérita, a Constituição Federal da República do Brasil, textos de doutrina jurídica, textos científicos da área da Psicologia, além de jurisprudência. Tem como objeto de estudo a guarda compartilhada de filhos menores, com vistas à materialização do princípio Constitucional denominado melhor interesse da criança e do adolescente. Durante o estudo foi realizada uma pesquisa de cunho principiológico e também de cunho histórico, para buscar os fundamentos da atual tutela jurídica relacionada à guarda de filhos menores. Ao final, após entender as modificações ocorridas nas últimas décadas no Direito Civil brasileiro, em especial no Direito de Família, concluiu-se que a guarda compartilhada, que é o regime mandamental imposto pelo Código Civil, em geral é o melhor regime de guarda para a concretização do preceito Constitucional relativo ao melhor interesse das crianças e adolescentes. Contudo, concluiu-se também que existem exceções e que a análise técnica multidisciplinar é indispensável para apoio à tomada de decisões dos magistrados em casos relacionados à guarda de menores.

Abstract: The present graduation work consists of a bibliographic review, whose research sources consulted were current and past legislation, the Federal Constitution of the Republic of Brazil, legal doctrine texts, scientific texts in the area of Psychology, in addition to jurisprudence. Its object of study is shared custody of minor children, with a view to materializing the Constitutional principle known as the best interest of children and adolescents. During the study, a research of a principled nature and also of a historical nature was carried out, to seek the foundations of the current legal protection related to the custody of minor children. In the end, after understanding the changes that have occurred in recent decades in Brazilian Civil Law, especially in Family Law, it was concluded that shared custody, which is the mandatory regime imposed by the Civil Code, is generally the best custody regime for the implementation of the Constitutional precept regarding the best interests of children and adolescents. However, it was also concluded that there are exceptions and that multidisciplinary technical analysis is essential to support the decision-making of magistrates in cases related to the custody of minors.
